‘Rapist’ Jamel McIver Is Still Out On The Streets Escaping Jail After Another Rape Case!

Law enforcement officials told The Post that a career criminal charged in a violent Upper West Side rape over the weekend should have been behind bars after breaking a plea deal in a different Bronx case, but that no one informed the judge of this.

According to sources and court documents, Jamel McIver, 30, who already had 15 arrests on his rap sheet, negotiated a deal in August to avoid jail time on a 2019 sex assault and burglary case in The Bronx if he completed a two-year in-patient drug rehab programme.

Without successful completion of the programme, he would be looking at a minimum of five years in prison.

But, the judge and prosecution were unaware that McIver had failed out of the programme during a hearing in February. Just over a week before the brutal Manhattan rape.

After allegedly failing to follow through on a plea deal in another attack. The man accused of raping a woman in a New York City staircase on Saturday should have been behind bars.

At roughly 1 a.m. on West 65th Street and West End Avenue, a lady aged 21 was attacked by Jamel McIver, 30. McIver was later charged with rape, burglary (sexually motivated), and criminal sex act. As far as we can tell, McIver was turned in by his own family.

According to the New York Post, law enforcement officials said that McIver should have been in jail. But that no one had informed the judge of this.

Police sources say he climbed up a fire escape in the Bronx and forced a 16-year-old girl to touch his genitalia over his pants in an earlier case.

McIver was taken into custody on Sunday in connection with the rape and burglary on the Upper West Side that occurred the day before.

After following the 21-year-old victim inside a building near West End Ave. and W. 65th St. at around 1:20 a.m. on Saturday, the suspect is said to have cornered her in an elevator and threatened to murder her before he was apprehended.

Prosecutors described the horrifying incident that occurred after the victim returned home from spending the night with her boyfriend. At McIver’s arraignment early Monday evening.

McIver allegedly said, “Do what I say or I’m going to f—-ing kill you,” according to the prosecution.

They said he then dragged her from the elevator and sexually attacked her in the stairway.

He allegedly warned twice, “Do not f—-ing say anything, or I will murder you,” while gesturing towards his back pocket as if to show he was armed.

According to the prosecution, McIver then raped the victim before forcing her to leave the building with him.

Authorities say he spewed, “If you contact the police or [I] see myself on the TV, I’m going to kill you,” before escaping.

The victim returned inside and woke a relative before dialling 911 once the offender had left. A local hospital attended to her needs.

There was surveillance footage of the alleged sexual offender at the incident. Which was recorded at West 65th Street and West End Avenue.

A lady, 21, told police that a man followed her into the building on Saturday morning. At approximately 1:20 a.m., he allegedly shoved her out of an elevator and into a stairway.

The woman claims that after the rape, the attacker pushed her back out onto the street and then took off.

A 2019 attempted rape charge against McIver stems from an incident. In which he broke into the Bronx apartment of a sleeping 16-year-old girl. He was implicated in that case when neighbours tipped off the police. And he has a court date set for March 29.

Bail for McIver’s 2019 arrest was set at $250,000. Since the prosecution did not move quickly enough under the swift trial rule, he was released on his own recognisance in March 2020.

To give him a second shot, the court gave him a no prison plea if he could complete two years of treatment. He agreed despite the fact that he understood that if he failed he would spend the full five years in jail.

The Bronx district attorney’s office will ask for his appearance in court on Tuesday to reinstate his entire five-year sentence because his arrest on the Upper West Side was a violation of the treatment programme.

McIver, who currently resides in East Harlem’s shelter for the poor and disabled, has a total of eight prior arrests dating back to 2017 and 2019.
