Conspiracy Suspects In The Sale Of Semiautomatic Firearms In New York City

Seven counts of an indictment accusing David Avery, Tajhai Jones, Ray Minaya, & Calvin Tabron with conspiracy to illegally transport more than 50 weapons were released this morning in federal court in Brooklyn.

Mccann and Minaya have also been charged with possession and distribution of cocaine base, with Mccann further facing charges of distribution and possession of fentanyl. This morning, police took into custody Mccann, Smith, Minaya, and Tabron.

This afternoon, U. S. Magistrate Judge Audrey A. Merkl will hear the arraignment of defendants Mccann and Minaya. Both Jones and Tabron are scheduled to appear in court in the Commonwealth of Virginia.

charges were announced by U.S. Attorney for such Eastern New York District Breon Peace, NYPD Commissioner Keechant L. Sewell, and DEA New York Division Special Agent in Charge Frank A. Tarentino, III.

“As accused, the defendants are convicted for attempting to overwhelm the neighborhoods in Brooklyn with over 50 hazardous firearms, particularly ghost guns, and drugs,” said Attorney Lieutenant Secretary of the United Nations Peace.

“The arrests are groundbreaking because they are the first in New York and the first in the country to apply unique federal legislation. tools available to more thoroughly prevent firearms traffickers from damaging our community,” she NY AG said.

“This ground-breaking legislation is meant to confront the sobering truth of the link between weapons and narcotics; the two major public safety risks in New York,” Frank Tarentino, DEA Special Coordinator, stated.

New York’s DEA and other law enforcement agencies are working tirelessly to avoid gun violence & drug trafficking in the city’s neighbourhoods.

I want to thank the New York Police Department, the Drug Enforcement Administration, and the U.S. Attorney’s Office for the Eastern New York District for their hard work and cooperation throughout this investigation.

“This case, begun in direct reaction to claims from the Urban Dwellers we serve, reveals certain frightening truths,” said NYPD Director Keechant L. Sewell.

“First, that many communities are still in need of our assistance, and that illicit guns are widely available and used.

Second, the extremely risky work that the men and women of the police force of New York City do daily to keep guns out of the hands of criminals is something that deserves our utmost respect.

I want to express my gratitude to the undercover NYPD officer who worked so diligently on this multi-year investigation, as well as the other detectives in our Violent Crimes Unit and our essential allies at the ATF, and DEA, as well as the U.S. Attorney’s Office for such Eastern New York District.

The indictment and other court documents say that somewhere between January 2022 through August 2022, the defendants sold at least 50 illicit guns in numerous transactions in Brooklyn.

This Transaction Wasn’t Even A Secret One

These firearms were sold in broad daylight, from vehicles parked near the Breukelen Homes, which are owned and operated by the New York City Department Of housing and are located in Canarsie, Brooklyn, across the road from a church and feet away from a daycare and grade school.

The defendants’ preferred methods of transporting the firearms they illegally traded included gloves and grocery bags.

The firearms were purchased by two persons of the gun-trafficking enterprise in Virginia before being brought to New York and eventually sold in Brooklyn. Some of the guns were constructed from “ghost gun kits” or had their serial numbers covered up, making them difficult for law authorities to track.

Two defendants were also involved in major drugs trafficking conspiracy, including a heroin distribution operation that released thousands of doses of the synthetic opioid into the local population.

Several of the sales of firearms and drugs by the defendants were recorded by an undercover police officer.

The undercover cop lied to the accused, saying he was a heroin dealer in need of firearms and that he planned to resell a few of the weapons they gave him. Despite this information, the conspirators were unfazed and kept selling weapons and drugs to the undercover police officer.

Several murders in Brooklyn have been connected to weapons sold in the conspiracy. In June 22, 2022, for instance, Minaya sold a.45 calibre Glock 30 to an undercover police officer.

According to the inquiry, this gun was utilized in a shooting that took place during a school day celebration on August 16, 2021, in Bedford-Stuyvesant. Eight people were shot and injured overall.

The conspirators also trafficked a Glock 43, 9 mm handgun, which was used in a shooting on December 18, 2021 at Canarsie, in the buildings adjacent to the Breukelen House complex. Several bullets pierced his torso, including his dominant wrist, shoulder, neck, and skull base.

Conclusion

Agents found two handguns, both with an extended magazine, when they apprehended Minaya this morning in Brooklyn. Both firearms were found after the defendant tossed one out a window.
