The fact that the affidavit and court documents pertaining to Kohberger’s extradition remain sealed is a “quirk” of Idaho law, according to Michael Mancuso, first assistant district attorney of Pennsylvania’s Monroe County, who spoke at a press conference following Kohberger’s extradition hearing on Tuesday.
An Idaho magistrate judge imposed a so-called “gag order” Tuesday evening, banning authorities from commenting publicly about many details of the case outside of court, including discussing the affidavit or other court records.
Judges can issue such orders if they believe that a defendant’s right to a fair trial is being jeopardised by pre-trial publicity.
Monroe County’s top public defender, Jason LaBar, who is representing Kohberger at the extradition hearing, has stressed that his client is eager to be vindicated.
“He believes he’s going to be exonerated,” LaBar said of the defendant on Tuesday’s episode of Today. Those are his own words, so it’s clear that’s what he thinks.
A former FBI agent, Jennifer Coffindaffer, told Newsweek that she thinks Kohberger wants to fight the charges against him “all the way.” On the other hand, she added that he is probably waiting to see how strong the evidence is against him.
